Applicability:

The terms and conditions on this page apply to all i3DGear products, including, but not limited to, autopilot parts, autopilot remote controls, firmware, instructions, videos and any advice, services, or other products rendered by i3DGear through this website, email, or direct correspondence of any kind.

Terms and Conditions:

To the fullest extent permitted by applicable law, i3DGear, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of use, loss of profits, loss of vessel time, or damage to property, arising out of or relating to the use, installation, or misuse of our products.

In no event shall i3DGear’s total aggregate liability for any claim arising from the purchase or use of a product exceed the amount paid for the product giving rise to the claim.

Nothing in these terms shall exclude or limit liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

By purchasing and using our products, you acknowledge that marine systems are inherently subject to environmental and operational risks, and proper installation, inspection, and maintenance are the responsibility of the vessel owner or installer.

 

Return Policies:

If your item is defective, we will replace it, provided you return the original item to us, undamaged and intact. The determination of whether or not the item is actually defective will be decided solely by i3DGear. Return shipping expenses, customs and duty are your responsibility. Shipping of a replacement will be paid by i3DGear and will be shipped by a method of i3DGear's choice. You may pay to upgrade your shipping to a higher level.

 

For non-defective items we do not offer returns. Due to the high costs of running this small volume business, and the high costs of shipping, returns or exchanges are not possible.

We do not refund any customs or duty fees you paid. Recovering these fees is your responsibility. Contact your home country’s customs office to apply for a refund of duty paid on a returned product.

For orders that are canceled by customer request before shipment, we charge the 4% credit card processor fee (which is not refunded to us by the credit card processor), plus a 6% i3DGear processing fee - for a total of 10%.

For parts which explicitly state LIFETIME WARRANTY - in the event your product becomes faulty during it's lifetime, please return it to us (at your expense) and we will replace it free of charge. Shipping of replacements will be by standard postal shipping. You may pay to upgrade your shipping to a higher level. Parts must have no obvious signs of intentional damage or mistreatment in order to qualify for lifetime warranty replacement and the judgement of this will be solely determined by i3DGear.

Shipping Policies:

Orders are shipped from the United States using USPS (United States Postal Service). International shipments are transferred to your country’s postal system in accordance with international mail agreements.

You may be responsible for import taxes, VAT, duties, or customs fees required by your country. These charges are determined by your local customs authority and are the responsibility of the recipient.

Tracking is provided for most shipments. If tracking is included with your selected shipping service, your tracking number will be emailed to you once your order has shipped.

If an untracked shipping option is selected, tracking information will not be available and we cannot obtain additional location details once the package is in transit.

Estimated delivery times are provided by the carrier and are estimates only. Shipping times are measured in business days and may be affected by customs processing, postal delays, or local delivery conditions.

Please ensure you are available to respond to any customs or delivery notifications once the shipment reaches your country, as delays caused by customs processing are outside of our control.

Risk Of Loss:

Our responsibility is to package your product, pay the shipping fees you have selected, and pass it to the carrier for delivery on your behalf. All risk of loss for items is passed to you upon our delivery to the carrier.

 

Privacy Policies and Cookie Management:

i3DGear does not store credit card or payment information.  We will not share your email address, physical address or any other personal information you provide to us through our website.

We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile.

When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.

We collect such Non-personal and Personal Information for the following purposes:

  1. To provide and operate the Services;

  2. To provide our Users with ongoing customer assistance and technical support;

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.  

 

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
